Challenge
Our client represented a telecommunication organization that found itself the target of an extremely aggressive plaintiff. Faced with an opposing counsel that was taking a no-holds-barred approach to electronic discovery, our client recognized the need to involve an objective third party to assist with developing FRCP-compliant data preservation and collection strategies in a very dynamic telecommunication system environment.
Solution
In partnership with our client, a Daegis® consultant met with the executive management team and IT personnel from the telecommunications organization to identify and inventory data sources that might contain potentially relevant evidence. Routine systems operations, IT policies and practices, and matters related to the accessibility of data were evaluated. Based on our interviews, we were able to recommend a FRCP-compliant data preservation and collection strategy and provide guidance for the implementation of best practices for the retention of ESI. Our data collection specialists were enlisted to use forensically sound technology to collect hard drive and network and systems database ESI for purposes of preservation and production and review.
